Terms of Service
These terms are an agreement between you and Deadman Secrets, LLC ("we", "us") for your use of Deadman Secrets, its apps and its website (the "Service"). By creating an account or using the Service you agree to them. Our Privacy Policy explains how we handle personal information.
1. What the Service does — and does not do
Deadman Secrets stores information you encrypt on your devices and, if you stop checking in as you have set it up, delivers it to the beneficiaries you choose.
- It is not a will or a legal instrument. It does not transfer ownership of property or accounts, and it is not legal, financial or tax advice. Make a will and speak to a professional about your estate.
- Delivery depends on you and on things outside our control. It relies on your check-in settings, on the contact details you give being correct and current, and on email reaching the people you chose. A switch may fire if you do not check in — for example while you are unwell or away — so set intervals and emergency contacts that suit you.
- Whether a beneficiary may use what you leave them — for example, an online account's own terms — is between them and that service.
2. Your account
- You must be 18 or older and able to make this agreement.
- Give an email address you control and keep it current.
- You are responsible for what happens under your account. Keep your password and recovery codes safe.
3. Encryption means we cannot recover your vault
Your vault is encrypted with keys derived from your password, which we never see. If you lose your password and your recovery codes, we cannot recover your vault, and no one at Deadman Secrets can read or restore it. This is how the Service protects you, not a defect.
4. Your content
What you store remains yours. You give us only the permission we need to store it, back it up and deliver it as you have set up. You are responsible for having the right to store and share what you put in your vault and for telling the people you add that you have added them.
5. Acceptable use
Do not use the Service to break the law; to store or send material that is illegal, or that infringes others' rights; to harass anyone; to send unsolicited messages; to attempt to break or probe our security, except through a disclosure we have agreed to; or to interfere with the Service or other people's use of it.
6. Plans, payment and gifts
- Paid plans are billed in advance, monthly or annually, through Stripe, and renew automatically until you cancel. You can cancel at any time; your plan continues to the end of the period you paid for.
- Payments are non-refundable, except where the law requires a refund. Cancelling stops the next renewal; you keep your plan until the end of the period you paid for.
- A lower plan has lower limits; see the current limits on our pricing page.
- We may change prices with at least 30 days' notice; a change applies from your next renewal.
- A gift plan lasts for the term bought. Before it ends the recipient is told, and at the end the account moves to the free plan unless they add payment.
- A free plan is offered as is and may change.
7. Suspension and termination
You may stop using the Service and ask us to delete your account at any time. We may suspend or end accounts that break these terms or put the Service or others at risk; where we can, we will tell you first and give you time to copy what you have stored. If we ever stop offering the Service, we will give at least 90 days' notice so you can copy what you have stored and make other arrangements.
8. Disclaimers
We work hard to keep the Service available and secure, but it is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including that the Service will be uninterrupted, error-free, or that any delivery will be made or received.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, and our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Some places do not allow these limits, so they may not apply to you.
10. Indemnity
You agree to cover our reasonable costs from claims arising from content you store or share in breach of these terms, or from your breach of the law.
11. Governing law
These terms are governed by the laws of the Commonwealth of Virginia, USA, and disputes will be resolved in the state or federal courts located in Virginia, except where the law of the place you live gives you the right to bring a claim there.
12. Changes
We may update these terms. If a change matters, we will tell you by email or in the app at least 30 days before it takes effect; if you keep using the Service after that, the new terms apply.
